Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MamtaNest platform, including the MamtaNest Admin app (for daycare centers) and the MamtaNest app (for parents), along with our website and related services (together, the "Service").

By creating an account, installing either app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. If you are using the Service on behalf of a daycare business, you confirm you have the authority to bind that business to these Terms.

MamtaNest is a daycare management platform consisting of two connected applications:

• MamtaNest Admin — used by daycare centers to manage attendance, child profiles, daily activities, fees, holidays, and communication with parents.
• MamtaNest (Parent app) — used by parents/guardians to view their child's attendance, activities, fees, and to message the daycare.

We may add, change, or remove features of the Service over time. We will make reasonable efforts to notify daycare admins of significant changes.

• Daycare admin accounts are created when a daycare signs up for the Service. The admin is responsible for all activity that occurs under their account.
• Parent accounts are created by the daycare admin at the time of enrolling a child, and parents are given login credentials by the daycare.
• You must provide accurate information when creating or updating an account, and keep your login credentials confidential.
• The Service is intended for use by daycare businesses and adult parents/guardians. Children do not have their own accounts and do not directly access the Service.

As a daycare admin using MamtaNest Admin, you agree that:

• You have obtained any consent required from parents/guardians before entering a child's information into the platform.
• You are responsible for the accuracy of the child, attendance, activity, and fee data you enter.
• You will only add staff members who are authorized to access your daycare's data, and will set appropriate permissions for each.
• You will not use the Service to collect or store information about children beyond what is reasonably necessary to operate your daycare.
• You are responsible for promptly removing a child's profile when they leave your daycare, as described in our Privacy Policy.

• You are responsible for keeping your login credentials confidential and for changing your password if you suspect unauthorized access.
• Information you view in the app (attendance, activities, fees, messages) is provided by your child's daycare — MamtaNest is not responsible for the accuracy of information entered by the daycare.
• You will use the messaging features respectfully and only for communication related to your child's care.

Where a daycare center pays for the Service, the following applies:

• Fees, one-time setup/development charges, and any Annual Maintenance Contract (AMC) amount are as agreed in writing (invoice or proposal) between MamtaNest and the daycare center.
• Unless otherwise agreed, an AMC covers bug fixes and minor changes to existing, already-delivered functionality only. New features or significant changes in scope are quoted and billed separately.
• Hosting, server, and domain costs are the responsibility of the daycare center, unless explicitly stated otherwise in a written agreement.
• Support and maintenance under an AMC are provided only while the AMC is active and renewed on time; access to ongoing support lapses if the AMC is not renewed.
• Fees already paid are non-refundable except where required by law or explicitly agreed in writing.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to another daycare's data or another parent's account
• Interfere with, disrupt, or attempt to reverse-engineer the Service
• Upload content that is abusive, harassing, or unrelated to daycare operations
• Use automated tools to scrape or extract data from the Service

• Data entered by a daycare (child profiles, attendance, activities, fee records) remains the property of that daycare center.
• MamtaNest acts as a service provider that stores and displays this data on the daycare's behalf, and does not claim ownership of it.
• MamtaNest will not use daycare or child data for advertising or sell it to third parties, as described in our Privacy Policy.
• On request, a daycare admin may ask for an export or deletion of their daycare's data, subject to the process described in our Privacy Policy.

The MamtaNest name, logo, apps, website, and underlying software are the intellectual property of MamtaNest. Except for the data you provide, nothing in these Terms grants you any right to use MamtaNest's trademarks, branding, or source code.

You retain no rights to the app software itself — your use is limited to accessing the Service as intended, for as long as your account or agreement remains active.

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may occasionally be unavailable for maintenance, updates, or due to factors outside our control (including hosting/server issues, which are the responsibility of the daycare where hosting is client-managed).

The Service is provided "as is" and "as available," without warranties of any kind beyond what is required by applicable law.

To the maximum extent permitted by law, MamtaNest and its developers shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service — including loss of data, loss of business, or loss of profits.

Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.

• You may stop using the Service at any time. A daycare admin may request account closure and data deletion as described in our Privacy Policy.
• We may suspend or terminate access to the Service for accounts that violate these Terms, or where payment for an active plan or AMC is significantly overdue, after reasonable notice.
• On termination, the daycare's right to access the Service ends; data retention/deletion is handled per our Privacy Policy.

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of India.

We may update these Terms from time to time to reflect changes in our features, legal requirements, or business practices.

• The "Last updated" date at the top of this page will be revised when changes are made
• For material changes, we will make reasonable efforts to notify daycare admins via the app or email
• Continued use of the Service after updated Terms are posted constitutes acceptance of the revised Terms
